Terms of Use

1. Agreement to These Terms

FindMeCheapFood.com and the FindMeCheapFood Android app (together, the "Service") are operated by Pacific Star LLC ("we," "us," or "our"). These Terms of Use ("Terms") are an agreement between you and us. By using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal information.

You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission of a parent or legal guardian who agrees to these Terms for you.

2. The Service

The Service helps you find restaurant deals, specials and discounts in the United States. It is free to use, does not require an account, and is supported by advertising. The Service is intended only for users in the United States; if you use it from elsewhere, you do so on your own initiative.

Tips you choose to send us (for example through the "Say Thanks" links) are voluntary, non-refundable, are not charitable donations and do not buy any extra service.

We may change, suspend or discontinue any part of the Service at any time, including which restaurants, cities and deals it covers, without notice and without liability to you.

3. Deal Information

We are not a restaurant and do not sell food, issue coupons or process payments. Deals shown in the Service are gathered and reviewed automatically from restaurants' public websites and other public sources, and this automated process makes mistakes. A deal may be inaccurate, incomplete, out of date, ended, limited to certain locations, days, times or customers, or subject to terms we do not show. Prices, distances, opening details and descriptions are approximate.

The restaurant alone decides whether to offer and honor a deal, and on what terms. We do not guarantee that any restaurant will honor a deal shown in the Service, and we are not responsible if it does not. Before relying on a deal, check it with the restaurant or on its website (each deal links to its source where we have one).

Rankings, scores and labels in the Service (such as "Recommended" ordering, deal values and community votes) are our automated estimates and the opinions of anonymous users (votes may be filtered to prevent abuse), not statements of fact about a deal or restaurant. The Service does not provide information about allergens, ingredients, nutrition, food safety or dietary suitability; ask the restaurant.

4. Restaurants, Trademarks and Third Parties

Unless we say otherwise, we are not affiliated with, endorsed by or sponsored by any restaurant or brand shown in the Service. Restaurant names, logos and trademarks belong to their owners and are used only to identify the restaurant and its deals.

The Service links to third-party websites and apps, including restaurant websites. We do not control them and are not responsible for their content, offers, products, privacy practices or availability. Your dealings with any restaurant or other third party are solely between you and them.

The Service uses Google Maps Platform features (such as place search and restaurant details). By using those features, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Some restaurant and map data comes from OpenStreetMap, © OpenStreetMap contributors, available under the Open Database License.

Restaurant owners: if a deal shown for your restaurant is wrong or you would like it removed, email [email protected] with the restaurant's name, address and the deal (or the logo or icon you would like removed), and we will review it promptly.

5. Advertising

The Service shows ads, including ads served by Google. Ads are provided by third parties; we do not endorse advertisers or their products, and any dealings you have with an advertiser are between you and that advertiser. Ads are labeled as ads. Restaurants do not pay us to list, rank or describe their deals. How ads use your information is described in our Privacy Policy.

6. Your Feedback and Votes

If you vote on deals, answer a survey, or send us feedback, suggestions or corrections ("Submissions"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, publish and otherwise use your Submissions for any purpose, including to improve the Service, without compensation or attribution to you. Submissions are not confidential. Do not include other people's personal information or anything you do not have the right to share.

7. Acceptable Use

You agree not to:

• Use the Service in violation of any law or the rights of others
• Use automated means to scrape, crawl or copy deals or other data from the Service, or use them to build a dataset or competing service (public search engines may index the website)
• Use content from the Service to train or improve an artificial intelligence or machine learning model without our written permission
• Manipulate votes, rankings or feedback, including through multiple identities, bots or coordinated activity
• Bypass or interfere with rate limits, security features or other technical limits, or overload, disrupt or attack the Service or its infrastructure
• Decompile, reverse engineer or modify the app, except where the law expressly allows it
• Generate fraudulent ad impressions or clicks, or encourage others to do so
• Send us spam, malware or unlawful, harassing or abusive content
• Misrepresent your affiliation with us, or suggest that we endorse you or your business

We may block or limit access by anyone we believe is violating these Terms.

8. Our Rights and Your License

The Service, including its software, design, text, graphics, illustrations, compilations of deals and other content we create, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service, and to install the app on devices you own or control, for your own non-commercial use. You may share links to deals and pages. All rights not expressly granted are reserved.

If you downloaded the app from Google Play, Google Play's terms also apply to your download and use of the app. Google is not responsible for the app or its content.

9. Copyright and Content Complaints

If you believe content on the Service infringes your copyright, email [email protected] with: a description of the work, the page address where the content appears, your contact details, a statement that you believe in good faith the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature. We will review and, where appropriate, remove the content.

10. Disclaimers

The Service and all deals, content and information in it are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and availability. We do not warrant that any deal is accurate, current or will be honored, that the Service will be uninterrupted, secure or error-free, or that defects will be corrected. Your use of the Service and any reliance on its content is at your own risk.

Nothing in these Terms limits rights you have that cannot be waived under the law of the state where you live, and these exclusions apply only to the extent that law allows.

11. Limitation of Liability

To the fullest extent permitted by law, Pacific Star LLC and its members, managers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, savings, data or goodwill, arising from or related to the Service or these Terms, including a restaurant's refusal to honor a deal, even if we have been advised of the possibility of such damages. Our total liability for all claims arising from or related to the Service or these Terms is limited to fifty U.S. dollars ($50).

These limitations apply only to the extent the law of the state where you live allows. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Pacific Star LLC and its members, managers and employees from claims, losses and expenses (including reasonable attorneys' fees) brought by third parties that arise from your misuse of the Service or your violation of these Terms. We may control the defense of any such claim, and you agree to cooperate with it.

13. Suspension and Termination

You may stop using the Service at any time. We may suspend or end your access to the Service at any time, including if we believe you have violated these Terms. Sections 3, 4, 6, 8 (except the license grant), 9, 10, 11, 12, 14 and 15 survive any termination.

14. Disputes and Governing Law

Before starting a court case, you and we agree to try to resolve the dispute informally. Send a written notice describing the dispute and the relief sought, with your name and contact details, to [email protected]; we will send ours to the contact details you have given us. If the dispute is not resolved within 60 days after the notice is received, either party may go to court. Time limits for bringing a claim are paused during those 60 days.

These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in the State of Washington, except that you may bring an individual claim in the small claims court where you live if it qualifies. You and we consent to those courts' personal jurisdiction.

15. General

These Terms are the entire agreement between you and us about the Service. If any provision is found unenforceable, it will be enforced to the maximum extent possible and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last updated" date above, and for material changes we will also give notice in the Service where we reasonably can. Changes take effect when posted, unless the notice says otherwise. If you keep using the Service after changes take effect, you accept the updated Terms.
